On this project, we were able to recover £39,000.00 against a bond value of £12,000.00 by enforcing the interest clause in Section 38 (Highways Act 1980) Agreement.
Through extensive discussions and enforcement of Section 38 (Highways Act 1980) Agreement, the Developer completed works to the value of £304,467.96 against a bond value of £126,000.00.
The Developer was dissolved, and the Surety Provider was in Administration. We were able to secure the full bond value of £208,469.00 from the Administrator.
